This website is operated by Iberian Lighting Ltd (“Iberian”, “we”, “us”, “our”). By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the site, including browsers, customers, trade clients, and contributors of content.

If you do not agree to these Terms, you may not access the website or use the Service. We may update these Terms from time to time by posting a new version on this page.

Bespoke nature of our products: All Iberian lampshades and lighting products are bespoke and made to order in our Hastings workshop to client specifications. As such, different terms apply compared with off-the-shelf retail goods.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that enables us to offer our Service to you.


SECTION 1 – ONLINE STORE TERMS

 

You represent that you are at least the age of majority in your jurisdiction, or have provided consent for any minor dependents to use this site. You must not use our site for any unlawful purpose or to violate any law (including intellectual-property laws). You must not transmit any malicious code. Breach of these Terms may result in immediate termination of your access to the Service.


SECTION 2 – GENERAL CONDITIONS

 

We reserve the right to refuse the Service to anyone, for any lawful reason, at any time. You understand your content (excluding payment card data) may be transferred unencrypted over various networks and adapted to technical requirements. Card data is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit the Service without our written permission.


SECTION 3 – ACCURACY, COMPLETENESS & TIMELINESS

 

The material on this site is provided for general information. We are not responsible if information on the site is not accurate, complete or current. Content may include historical information provided for reference only. We may modify site contents at any time and have no obligation to update any information. Your reliance on site material is at your own risk.


SECTION 4 – MODIFICATIONS TO THE SERVICE

 

We may modify, suspend, or discontinue any part of the Service without notice. We shall not be liable to you or any third party for such modifications or discontinuance.


SECTION 5 – PRODUCTS & SERVICES (BESPOKE / MADE-TO-ORDER)

 

  • Bespoke only: All Iberian products are custom-made to order. We do not offer “buy-now” off-the-shelf products.

  • Visuals & colours: We make every effort to display colours and images accurately, but monitors and devices vary; minor differences may occur.

  • Availability & changes: We may limit sales by person, region, or jurisdiction and may change or discontinue products or materials at any time. Descriptions and pricing may change without notice.

Returns & cancellations (consumers and trade):

  • Because all goods are bespoke, cancellation or return rights do not apply once production has begun, except where goods are faulty.

  • In line with the Consumer Contracts Regulations 2013, the usual 14-day cancellation period for distance/online sales does not apply to bespoke or made-to-order goods.

  • This does not affect your statutory rights under the Consumer Rights Act 2015, which entitle you to a repair, replacement, or refund if goods are defective.


SECTION 6 – ACCURACY OF BILLING & ACCOUNT INFORMATION

 

We may refuse or limit any order (including by account, card, billing or shipping address). If we change or cancel an order, we may attempt to notify you using the contact details provided. You agree to provide current, complete, and accurate purchase and account information and to promptly update details (including email and payment information) so we can complete transactions and contact you as needed.


SECTION 7 – CONSULTATION & DEVELOPMENT SUPPORT

 

Every order includes a basic consultation at no extra charge covering:

  • Specification checks (size, proportion, fittings)

  • Guidance on fabric suitability and fire-safety compliance

  • General advice on finishes and installation considerations

The complimentary service does not include multiple rounds of revisions, CAD drawings or rendered visuals, prototypes/samples, site visits, or extended project management. Where a project requires these, we will provide a quotation for Extended Consultation & Development Services.


SECTION 8 – MATERIALS, CRAFTSMANSHIP & TOLERANCES

 

All products are handmade. Natural variations in fabric, dye lots, finish, and minor dimensional tolerances are inherent to bespoke craftsmanship and are not considered defects. Fabric creasing arising from transit or storage is not a defect; we can provide care guidance on request.


SECTION 9 – CUSTOMER-SUPPLIED MATERIALS & COMPONENTS (COM)

 

Where a client supplies their own fabrics, linings, trimmings, or other components (“COM”), the following conditions apply:

  • Iberian will exercise reasonable skill and care in handling COM, but all risk relating to suitability, performance, and durability of such materials remains with the client.

  • Iberian is not responsible for defects, failures, or premature wear arising from COM, including (but not limited to) dye migration, shrinkage, creasing, stretching, or structural weaknesses.

  • Any additional labour, wastage, or reworking required due to faults in COM may be chargeable.

  • Clients are responsible for ensuring COM complies with all relevant legal, safety, and fire-retardancy standards for the intended use. Iberian accepts no liability for compliance failures in COM unless expressly agreed in writing.

  • By supplying COM, the client warrants that they own or have the rights to use the materials provided, and that such use will not infringe any third-party rights.


SECTION 10 – DELIVERY, INSPECTION & DAMAGES

 

Delivery charges are quoted separately and typically apply to UK mainland only (additional costs may apply for offshore/overseas). Delivery times are estimates and may be affected by factors outside our control.
Please inspect goods on delivery where possible. Any transit damages or visible defects should be reported to us within 7 working days so we can assist promptly. For consumers, this does not affect your statutory rights (including remedies under the Consumer Rights Act 2015).


SECTION 11 – WARRANTY & STATUTORY RIGHTS

 

Iberian products carry a 12-month warranty against manufacturing defects under normal use. This warranty is in addition to your statutory rights under UK consumer law, where applicable.


SECTION 12 – PRICING & QUOTATIONS

 

All pricing is exclusive of delivery unless otherwise stated. Quotations are typically valid for 90 days from issue; orders placed thereafter may require revision. Prices are based on the specification and quantities provided at quote stage; changes may affect price.


SECTION 13 – INTELLECTUAL PROPERTY

 

Client-supplied designs:
We will not knowingly reproduce or copy third-party designs without permission. Where you supply designs, drawings, artwork, reference products, or other intellectual property, you are responsible for ensuring you hold the necessary rights and that no infringement occurs. By placing an order, you warrant that you have obtained all necessary permissions/licences. You agree to indemnify Iberian Lighting against any claims, losses, or liabilities arising from IP disputes linked to client-supplied designs.

Iberian-developed solutions:
Any design, drawing, prototype, fitting, method, or engineering solution developed by Iberian Lighting in the process of fulfilling a bespoke order shall remain the sole intellectual property of Iberian Lighting Ltd. The client acquires no rights in such IP, except for a licence to use the finished product as supplied. Iberian reserves the right to adapt or reuse such solutions in future projects.


SECTION 14 – OPTIONAL TOOLS & THIRD-PARTY LINKS

 

We may provide access to third-party tools “as is” and “as available” without warranties and without liability. Third-party links may direct you to sites not affiliated with us; we are not responsible for examining or evaluating third-party content and accept no liability for third-party materials, products, websites, or transactions. Please review third-party policies before engaging in any transaction with them.


SECTION 15 – USER COMMENTS & SUBMISSIONS

 

If you send us comments, ideas, or materials (with or without request), you grant us a non-exclusive right to edit, copy, publish, distribute, translate, and otherwise use them in any medium, without obligation to maintain confidentiality, compensate you, or respond. You agree your submissions will not violate any third-party rights (including IP, privacy, or publicity), nor contain unlawful or malicious content. You are solely responsible for your submissions.


SECTION 16 – PRIVACY

 

Your submission of personal information is governed by our Privacy Policy (see the link in our site footer). Please review it to understand how we process your data.


SECTION 17 – ERRORS, INACCURACIES & OMISSIONS

 

Occasionally information on the site may contain typographical errors or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change or update information (including after you have submitted your order) as permitted by law.


SECTION 18 – PROHIBITED USES

 

You must not use the site or its content for unlawful purposes; to infringe IP rights; to harass, abuse, defame, or discriminate; to submit false or misleading information; to upload malware; to collect personal data without consent; to spam or scrape; or to bypass security features. We may terminate access for prohibited uses.


SECTION 19 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

 

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable. The Service and all products are provided (except as expressly stated) “as is” and “as available.”

To the fullest extent permitted by law, Iberian Lighting Ltd and its affiliates shall not be liable for any indirect, incidental, special, or consequential losses arising from the use of the Service or products. Nothing in these Terms affects your statutory rights under UK consumer law.


SECTION 20 – INDEMNIFICATION

 

You agree to indemnify and hold harmless Iberian Lighting Ltd and our affiliates, officers, directors, employees, agents, contractors, licensors, service providers, and suppliers from any claim or demand (including reasonable legal fees) arising out of your breach of these Terms or your violation of any law or third-party rights.


SECTION 21 – SEVERABILITY

 

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions shall continue in full force and effect.


SECTION 22 – TERMINATION

 

These Terms are effective unless and until terminated by either party. We may terminate or suspend access to the Service at any time where you breach these Terms. Termination does not affect obligations and liabilities incurred prior to the termination date.


SECTION 23 – ENTIRE AGREEMENT

 

These Terms, together with policies posted on the site, constitute the entire agreement between you and us and supersede any prior agreements regarding the Service. Any ambiguities shall not be construed against the drafting party.


SECTION 24 – GOVERNING LAW

 

These Terms and any separate agreements whereby we provide you the Service are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
